Welcome to Where's My Gun? ("Service", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our website and services located at wheresmygun.app (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms.

By creating an account or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Where's My Gun? provides a status tracking and customer communication platform designed for Federal Firearms Licensees (FFLs) and gunsmith operations. The Service includes work order management, customer portal access, automated notifications, and compliance tracking features.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

4. Subscription and Payment

The Service is offered on a subscription basis. By subscribing, you agree to pay all applicable fees according to your selected plan. Subscription fees are billed monthly in advance and are non-refundable except as required by law or as explicitly stated in these Terms.

We reserve the right to modify our pricing with 30 days' notice to subscribers.

5. Free Trial

We may offer a free trial period for new users. At the end of the trial, your account will require a paid subscription to continue using the Service. We reserve the right to modify or discontinue trial offerings at any time.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Violate any federal, state, or local firearms regulations
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or any systems connected to the Service
  • Use the Service to transmit malware, viruses, or other harmful code
  • Impersonate any person or entity
  • Harvest or collect user information without consent

7. Data and Content

You retain ownership of all data and content you submit to the Service. By using the Service, you grant us a limited license to use, store, and process your data solely to provide the Service to you.

You are responsible for maintaining backups of your data. While we implement reasonable security measures, we are not liable for any data loss.

8. Compliance Disclaimer

While the Service includes features to assist with ATF record-keeping, it is provided as a supplemental tool and does not replace official ATF bound books or other required records. You remain solely responsible for compliance with all applicable federal, state, and local firearms regulations.

9. Intellectual Property

The Service and its original content, features, and functionality are owned by Where's My Gun? and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason at our sole discretion.

You may cancel your subscription at any time through your account settings. Upon cancellation, your access will continue until the end of your current billing period.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WHERE'S MY GUN?, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date." Your continued use of the Service after any changes constitutes acceptance of the new Terms.
